Terms & Conditions of Sale and Use
The rules that apply when you browse the Store and place an order.
1. Parties and scope
These terms govern the use of this website and every sale between MOCLAUS COLLECTION, operated by [À COMPLÉTER / TO BE COMPLETED: legal name and legal form], RCCM [À COMPLÉTER / TO BE COMPLETED: RCCM number], NIU [À COMPLÉTER / TO BE COMPLETED: NIU], registered office [À COMPLÉTER / TO BE COMPLETED: address] (the “Seller”, see our Legal Notice), and any person ordering through the site (the “Customer”). By placing an order you confirm that you have read and accepted them. These terms are provided in English and French; the two versions have the same meaning.
They are governed by Cameroonian law, in particular Law No. 2011/012 of 6 May 2011 framing consumer protection, Law No. 2010/021 of 21 December 2010 governing electronic commerce, and the OHADA Uniform Acts where they apply to commercial sales. Nothing in these terms removes a right that mandatory law gives to a consumer.
2. Products and descriptions
We sell women’s handbags and shoes. We describe and photograph products as accurately as we can, but screen colours, sizes and finishes can differ slightly from the item received. Products shown as “Ready to Ship” are in stock at our Douala hub. Products shown as “Pre-Order” are sourced from overseas partner suppliers (including China) and delivered after arrival and inspection.
Third-party brands. Brand names, logos or trademarks of third parties belong to their owners and are used only to identify styles or describe a design. MOCLAUS COLLECTION is not an authorised retailer of, and is not affiliated with or endorsed by, those brands. Products are not offered as original or brand-authorised unless the product page clearly says so.
3. Prices
Prices are shown in Central African francs (FCFA / XAF). Other currencies shown on the site are indicative conversions only; the amount payable is in FCFA. Prices are [À COMPLÉTER / TO BE COMPLETED: “VAT included” or “VAT not applicable”, as confirmed by the owner and accountant]. Delivery fees are shown separately before you confirm the order. The price applicable is the price displayed when you confirm the order. We may change prices at any time, without effect on orders already confirmed. If a price is clearly wrong, we will tell you and give you the choice to confirm at the correct price or cancel with full refund of any amount paid.
4. Ordering and confirmation
- Add items to the cart, choose colour and size, and go to checkout.
- Enter your name, phone, email, delivery city and address, and choose a payment method. Before confirming, you can review your order, total and delivery fee and correct any error.
- Submit the order. We acknowledge receipt, then confirm the order with you, normally on WhatsApp. The sales contract is concluded when we confirm that we accept your order, subject to stock availability and payment where required.
- If an item turns out to be unavailable, we will tell you and offer an alternative, a later date or a refund.
Each customer must be an adult with the legal capacity to contract and must give accurate information. On request, we will give you a written or electronic document recording your sale.
5. Payment
Accepted methods: MTN Mobile Money, Orange Money, and Cash on Delivery (Douala and Yaoundé only). We never ask for your mobile-money PIN. Pre-orders and certain orders may require advance or full payment, which we will state when confirming the order. [À COMPLÉTER / TO BE COMPLETED: deposit rules for pre-orders, if any] Ownership of the goods passes to you on full payment and delivery.
6. Delivery
Delivery is made to the address you give. Current zones, fees and indicative times:
| Destination | Standard fee | Indicative time (Ready to Ship) |
|---|---|---|
| Douala and Yaoundé | 2,500 FCFA (express 4,000 FCFA) | 24 to 48 business hours |
| Bafoussam, Limbe, Kribi | 3,500 FCFA | 3 to 5 business days |
| Garoua, Maroua, Ngaoundéré | 4,500 FCFA | 4 to 6 business days |
Delivery is free on orders above 50,000 FCFA. Pre-orders arrive at our Douala hub in an estimated 12 to 16 business days, followed by up to 24 hours of inspection, then local delivery on the times above. Times are estimates, not guarantees, and run from order confirmation (and payment where required). Details are on our Delivery & Shipping page, which prevails on current fees and times. Please be reachable on the phone number you provide. If delivery fails because of wrong details or absence, we may charge a new delivery fee. Check the parcel on receipt and tell us of any visible damage or error immediately.
7. Returns, exchanges and withdrawal
Our sizing exchange. In addition to your legal rights, we offer a 7-day sizing exchange: contact us within 7 calendar days of delivery to ask for another available size or store credit. Items must be unworn, unwashed, unaltered and returned in their original packaging with tags and cards intact. See our Returns & Exchanges page.
Your legal rights. Under Articles 20 to 22 of Law No. 2010/021, a consumer buying online may, in the cases and on the conditions the law sets, withdraw within fifteen (15) days from the day after receipt of the goods, notifying us by electronic means or any other appropriate means; the consumer bears the return cost and, if the goods have not been altered, we refund the sums received within fifteen (15) days of the return. A consumer may also return a product within fifteen (15) days of delivery if it does not match the order or was not delivered within the agreed time, and we then refund within fifteen (15) days of the return. The law lists exceptions (for example personalised goods, or goods that cannot be returned). Our exchange policy does not reduce these rights, and these terms must be read so as to preserve them. [À COMPLÉTER / TO BE COMPLETED: lawyer to confirm how the 7-day exchange and the statutory 15-day withdrawal are presented together]
Defective or non-conforming goods. If an item is defective or not as ordered, tell us promptly with photos and your order reference. We will repair, replace or refund as appropriate. Legal guarantees and the consumer’s statutory remedies are not excluded.
8. Cancellation
You may ask to cancel before dispatch by contacting us on WhatsApp with your order reference; if the order has not been shipped (or, for a pre-order, not yet ordered from the supplier), we will cancel and refund amounts paid. We may cancel an order for unavailability, suspected fraud, an obvious pricing error or non-payment, and will refund any amount received.
9. Refunds
Refunds are made by the same channel as payment (MTN MoMo or Orange Money) within the delay set by law, and in any case within fifteen (15) days of the return or acceptance of the claim.
10. Use of the website and accounts
You agree to use the site lawfully, to keep your sign-in details confidential, and not to attempt to disrupt, scrape at abusive volume, or gain unauthorised access to the site or its data. You are responsible for activity on your account. Unauthorised access or interference with computer systems may be punishable under Law No. 2010/012 of 21 December 2010 on cybersecurity and cybercriminality.
11. Intellectual property
The site, its design, texts and images are protected. You may not copy or reuse them for commercial purposes without our written permission. See the Legal Notice for third-party brands.
12. Personal data and cookies
We process your data as described in our Privacy Policy and Cookie Policy.
13. Liability
We are liable for our obligations under these terms and under mandatory law. We do not exclude or limit liability where the law forbids it, including for defects in the goods supplied to a consumer. Subject to that, we are not liable for indirect loss, for delays or failures caused by third parties we do not control (for example couriers, mobile-money networks or internet outages) beyond what the law provides, or for use of the site contrary to these terms.
14. Force majeure
Neither party is liable for a failure or delay caused by an event beyond reasonable control, such as natural disaster, strike, road closure, civil unrest, customs or transport disruption, or telecommunications or power failure. We will inform you and the affected obligation is suspended; if it lasts more than [À COMPLÉTER / TO BE COMPLETED: e.g. 30 days], either party may cancel the affected order and we will refund amounts paid.
15. Customer service and complaints
Write to us on WhatsApp (+237 680 60 11 75) or through the contact page with your order reference. We aim to reply within [À COMPLÉTER / TO BE COMPLETED: e.g. 48 hours]. Consumers may also turn to consumer associations and the competent authorities, such as the ministry in charge of commerce.
16. Governing law and courts
These terms are governed by Cameroonian law. Disputes that cannot be settled amicably will be brought before the competent courts of [À COMPLÉTER / TO BE COMPLETED: court seat, e.g. the courts of the city where the Seller’s registered office is located], without prejudice to any mandatory rule that gives a consumer another competent court.
17. Changes
We may update these terms. The version in force on the day you place your order applies to that order. The latest version is always available on this page.
